    Nebraska Certifies Online Sports Betting Ballot Measures Ahead Of November Vote

    Nebraska voters will decide in November whether to open a mobile sports betting market tied to the state’s licensed racetracks.

    The Secretary of State’s office confirmed on Friday, 21 August, that two related petitions had cleared their signature and county-distribution requirements for the 3 November general election.

    The constitutional petition cleared with at least 138,473 valid signatures from 64 counties, while the companion statute gathered 96,918 valid signatures from 55 counties.

    The constitutional measure would amend Article III, Section 24, permitting the legislature to authorise and regulate internet sports wagering across the state.

    Current language in the measure stipulates that a bettor must be physically located in Nebraska when placing a wager, with the companion statute providing the full operating framework.

    The proposal would allow authorised gaming operators to offer online betting directly or through contracted platform providers, with servers required to be housed inside Nebraska.

    Operators and their platform providers would submit operating controls to the State Racing and Gaming Commission for approval, with the commission given until 1 June 2027 to write rules.

    The statutory measure would take effect on 1 January 2027 and would also require winnings to be checked against the state debt-collection system before any payment is made.

    Election officials stopped verification once each petition count reached 110% of the applicable requirement, as permitted under state law.

    Nebraska’s current law restricts sports wagering to approved windows and kiosks inside licensed racetrack enclosures, with mobile betting remaining entirely prohibited for bettors aged 21 and over.

    Every neighbouring state now offers sports wagering in some form, with Colorado, Iowa, Kansas, Missouri, and Wyoming all permitting statewide mobile betting.

    Previous legislative attempts to bring mobile betting to Nebraska have fallen short, including a 2024 special-session package known as LR3CA and LB13, which was indefinitely postponed.

    Last year, LR20CA reached Select File before stalling, and alongside companion bill LB421, it was indefinitely postponed in April, continuing a frustrating pattern for mobile betting supporters.

    Nationally, sports betting is now legal in 39 states and Washington, DC, with US commercial gaming generating a record $78.72bn last year, a rise of 9.2% from 2024.

    Sports betting alone contributed $16.89bn to that total, representing a 22.6% increase, though May figures showed a slight dip of 1.8% to $1.34bn on $12.06bn in wagers.

    The American Gaming Association has attributed part of that May decline to expanding sports prediction market activity, which is increasingly drawing attention from regulators and operators alike.
