Unlicensed Betting Sites Surge As Flamengo Sounds R$430m Alarm At Brazil Supreme Court Hearing

Within three days of Brazil’s betting ban taking effect, a monitoring tool identified 543 new unlicensed gambling sites operating in the country.

That figure, reported during proceedings at Brazil’s Supreme Court, underscores the unintended consequences that opponents of the ban have been warning about.

Only two of those newly detected domains were registered after the ban itself came into force, suggesting the grey market was already primed to absorb displaced demand.

The ban, enacted through Provisional Measure 1.394/2026, dissolved Brazil’s regulated betting framework and has sent shockwaves through the sports and gambling industries.

Football club Flamengo placed a R$430m figure on its potential losses, with club representative Willeman telling the court the organisation had structured its financial planning around betting sponsorship deals for the next four to five years.

Willeman pressed the court directly on the practical consequences for clubs across the country, asking: “How will Flamengo and every club honour commitments due early next year with this abrupt withdrawal of regulation?”

Beyond one club’s balance sheet, the broader argument presented to the Supreme Court tied the ban to sponsorship collapses, widespread job losses, and a significant reduction in tax revenue for the Brazilian state.

At the centre of the legal proceedings is Justice Luiz Fux, who chaired the public hearing on 3 November and made clear he was not treating the matter as settled.

Fux acknowledged that legitimate operators and commercial partners had built businesses around the regulatory structure that the provisional measure abruptly removed, leaving them with little recourse or warning.

His framing of the hearing signalled genuine receptiveness to arguments that had emerged since the ban was introduced, telling attendees that he is “listening to society to add arguments that came later.”

Fux reinforced that position by describing the legal process in terms that went beyond a conventional judicial review, stating: “The process is not a one-sided dialogue, but a participatory democratic process.”

The timing of the hearing adds urgency to the debate, with Congress scheduled to hold its own vote on the betting ban no later than 23 November.

No injunction blocking the measure had been granted at the time of the hearing, meaning the ban remains in force while legal and legislative challenges continue to develop in parallel.

The combination of a looming congressional deadline, a Supreme Court justice openly weighing new evidence, and a rapidly expanding unlicensed market creates significant pressure on Brazilian authorities to reach a resolution quickly.

How lawmakers and the court respond in the coming weeks will likely determine whether Brazil’s regulated betting industry can be revived or whether the grey market consolidates its position permanently.
