    Finland’s Supreme Administrative Court Scraps Spin-By-Spin Tax Rule For Online Slot Players

    Finland’s Supreme Administrative Court has overturned the spin-by-spin tax treatment applied to online slot games operated outside the European Economic Area.

    The ruling marks a significant shift in how Finnish tax authorities must calculate taxable income from online gambling activity on non-EEA platforms.

    The court voted 3-2 in favour of requiring the Tax Administration to change its approach to individual spins for games based in jurisdictions such as Curaçao.

    Rather than taxing each spin individually, the court determined that taxable income must be calculated across each complete session of play.

    However, the ruling comes with an important caveat that will still leave some players facing unexpected tax liabilities despite overall losses.

    Losses from one gaming session cannot be offset against profits from another, meaning a player could lose money overall while still owing considerable tax on winning sessions.

    The decision was reported by Finnish news outlet Taloustaito, which also noted the Tax Administration now needs to update its policies to reflect the court’s new direction.

    A separate but closely related ruling on professional sports betting is also expected imminently, according to reports, which could further reshape Finland’s gambling tax landscape.

    The ruling arrives during a broader period of regulatory change in Finland, with the country’s gambling market liberalisation expected to be completed by the summer of next year.

    Affiliates have emerged as a particularly contentious issue within that legislative process, with the future framework set to ban them from operating in Finland from July 2027 onwards.

    Finland’s path toward a liberalised gambling market has drawn criticism from various quarters, with concerns raised about how the government has managed the transition ahead of the structural overhaul.

    The Supreme Administrative Court’s decision sets a new legal precedent for how online gambling winnings are treated, and will require meaningful administrative adjustments across Finland’s tax authorities going forward.
