Gambling Blocks Shown To Fail Against Offshore Sites As Santander Faces Ombudsman Refund Order

The technology that UK banks rely on to protect problem gamblers has been exposed as inadequate against offshore gambling platforms, a recent Financial Ombudsman ruling confirms.

Even after Santander activated an international block on gambling transactions for one customer, the individual — identified only as Mr R — reported he was still able to place bets.

The case centres on a man who, following the July 2025 sale of his house, channelled gambling funds exclusively through offshore companies operating outside UK licensing jurisdiction.

Mr R formally disclosed his gambling addiction to Santander in mid-August 2025, prompting the bank to establish additional restrictions on his account.

When those measures proved insufficient, Mr R escalated the matter to the Financial Ombudsman Service on 17 September 2025.

The Ombudsman ruled that Santander bears financial responsibility for identifiable gambling losses, minus any winnings, that occurred between 15 August and 17 September 2025.

Before 15 August, the Ombudsman found no grounds to hold Santander accountable, concluding that the customer carried responsibility for managing his own restrictions before notifying the bank of his problem.

Santander, which had disputed its liability throughout the process, has now been ordered to issue the refund covering that defined window of losses.

The ruling throws a harsh spotlight on a structural weakness that affects every major bank in the United Kingdom, all of which currently offer some form of gambling payment block to customers.

GambleAware and the Gambling Commission have actively promoted these tools as an additional protective layer for consumers, and GambleAware co-produced guidance with the University of Bristol titled “A Blueprint for Bank Card Gambling Blockers.”

Santander itself introduced its gambling block as far back as mid-2019, placing it among the earlier adopters of the safeguard within the British banking sector.

Yet the offshore gambling industry presents a challenge that existing blocking infrastructure appears ill-equipped to handle, with unlicensed .com operators proving difficult to filter even for large multinational institutions.

Industry observers have likened this segment of the market to a hydra, where blocking one payment route does little to prevent funds from reaching another offshore channel.

Critically, no updated guidance on gambling payment blocks has been issued to banks since 2022, leaving institutions to manage an evolving problem with ageing frameworks.

The gap between regulatory guidance and the current capabilities of offshore gambling networks represents a growing liability risk for UK banks navigating their duty-of-care obligations.
